When and how did Britain claim Sovereignty over Australia?

What is extraordinary about the British claim of Sovereignty over the eastern half of New Holland and Van Diemen's Land is the extent of the area it covered. Even for a Radical Title, which is a term used for how European Powers could claim precedence over certain lands, to negotiate Rentals, Purchases or Treaties ahead of other European Powers, this claim went far wider than the lands ostensibly "discovered" by Cook. On top of this, this Radical Title was then coupled with the decision to give the British Crown full beneficial ownership.

Enshrinement of the Voice to Parliament and wide participation of Aboriginal and Torres Strait Islander peoples in the voice will remove the last barrier for decolonisation of Australia. That is the true agenda behind the Uluru Statement.
It will not give land back, reparations, internationally-binding negotiated terms or the truth. Just like 1967 was for the benefit of the colony, so is the Uluru Statement.

First Nations' affairs are in a deep abyss because there is a lack of common purpose, fueled by misinformation and spin, which leads to the risk of entrapment into an assimilation push that negates our First Nations sovereignty. The First Nations Voice to Parliament clause will be "non justiciable" so if the government refuses to listen to the 'Voice' or constitutes the Voice in a way that's not democratic or whatever there will be no recourse to the courts. It quite literally creates no constitutional rights: "Modest and substantive ".

The announcement on 30 September 2020 of the approval for the Santos coal seam gas extraction in the Pilliga reflects the many ways the colonising power overrides First Nations, this time it's the Gomeroi/Kamilaroi Nation. 850 gas wells are proposed in the Pilliga, where our ancient Stories are now threatened in the place we call Girraween, Place of Flowers - created for the purpose of ensuring that we have a sustainable seedbank for our ecological systems within the eastern states. It also holds the Gomeroi creation site of the Kangaroo and Emu.

This report tabled in the British House of Commons in 1837 is very telling on the attitudes and information received on the state of their colonies. The report for New Holland (now known as Australia) begins here:
'The inhabitants of New Holland, in their original condition, have been described by travelers as the most degraded of the human race ; but it is to be feared that intercourse with Europeans has cast over their original debasement a yet deeper shade of wretchedness.

Ghillar Michael Anderson announces today that, after years of discussion and consultations with senior Law men and senior Law women, they have now founded the Wati Law Council in the Western Desert cultural block and, in the case of the Euahlayi Nation in the east of Australia, the Euahlayi Law Council. Discussions are continuing with other Nations’ ceremonially educated Law-holders. The processes and procedures that have been adopted are to formalise the ancient Customary Law procedures for the modern era.

'Over Cooked': Is Captain Cook the source of British sovereignty in Australia?

The story of Lieutenant James Cook and British Sovereignty over Australia has been overcooked. At no time on any of Cook's three voyages to the Pacific was he intending to go anywhere near New Holland. He did chart the east coast of New Holland in 1770, but that was not part of his Instructions. The whole story about Cook and his association with the claim of British Sovereignty over the lands now known as Australia is retrospective, rather than consistent with the events of the time. Cook's initial "mission" was to get to Tahiti to study the Transit of Venus, and to then look for the fabled Great Southern Land, Terra Australis.

Colonial law is a law that cheats all our Peoples out of our ownership of all our lands, water and natural resources and ownership of all of our native flora and fauna, which are our families through our Totemic Law rules.
Native Title laws keep us outside in the drought without shade and we are burning up, just like our native bush. The 'two bob black trackers' control all negotiations and dictate what they say our people should get and agree to.

These State and Territory Treaty processes are not focusing on the key issues that our Peoples have been marching for on the streets. Whether Australians like it or not there are two regimes operating today in Australia: The Law of the Land belonging to Sovereign First Nations and Peoples under our own Laws and customs and the imposed colonial system originating from Britain. As Nations and Peoples, we need to stand strong and firm in our commitment to get it right, to assert our sovereign rights. We owe it to our future generations.

The rush by the States to Treaty is to try and legitimise their claim to sovereignty. It's not about our Sovereign Rights

To assert our sovereignty effectively we need to watch out for the colonial trickery and traps. Whilst the occupying power of the Crown may say they recognise that First Nations' sovereignty has never been ceded the fact is, in some States like Victoria, the government has already totally assimilated the people through their Treaty Commission legislation, which specifies that a treaty is between the colony of Victoria and Aboriginal Victorians. So, with this the case, inherent First Nations sovereignty is being usurped by the colonial jurisdiction.
